Terms of Service

⚠️ Alpha Software — Read Before Using

AitherOS is in active alpha development. There is no reasonable expectation of data privacy, security, redundancy, or availability. By using this service you acknowledge these limitations and accept all associated risks.

Section 1

Alpha Status Warning

AitherOS is currently in ALPHA. This means the software is under active development and is not considered stable, complete, or production-ready.

By using AitherOS or any Aitherium service (including demo.aitherium.com), you acknowledge and accept that:

  • There is NO reasonable expectation of data privacy or confidentiality
  • There is NO reasonable expectation of data security or encryption
  • There is NO reasonable expectation of data redundancy or backup
  • There is NO reasonable expectation of service availability or uptime
  • Data may be lost, corrupted, exposed, or deleted at any time without notice
  • Features may change, break, or be removed without warning
  • The system may be reset, wiped, or taken offline at any time

Acceptance of Terms

By accessing or using AitherOS, the Aitherium website, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

These terms apply to all users, including visitors, registered users, and anyone interacting with the demo instance at demo.aitherium.com.

Section 3

No Warranties — "As-Is" Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Aitherium makes no warranty that the Service will be uninterrupted, timely, secure, or error-free. There is no Service Level Agreement (SLA). There is no uptime guarantee. There is no data retention guarantee.

Section 4

Data & Privacy

During the alpha phase, data handling is best-effort only. Specifically:

  • Any data you input into the demo instance (demo.aitherium.com) may be visible to other users or to the system operator
  • Conversations, uploaded files, generated content, and any other data may be logged for debugging and development purposes
  • Data may be deleted, corrupted, or lost without notice during updates, resets, or infrastructure changes
  • No encryption guarantees are made for data at rest or in transit beyond standard HTTPS
  • When self-hosted, AitherOS runs entirely on your hardware — but the demo instance is a shared environment

Section 5

User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or systems
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Use the Service to generate, store, or transmit harmful, abusive, or illegal content
  • Reverse engineer, decompile, or attempt to extract the source code of any proprietary components
  • Use automated systems (bots, scrapers) to access the Service in a manner that exceeds reasonable usage

Intellectual Property

AitherOS and all associated software, documentation, branding, and content are the proprietary property of Aitherium. Alpha access does not constitute a license grant, transfer of ownership, or right to redistribute.

The public GitHub repository (aitheros-alpha) contains preview materials shared for informational purposes. The source code license will be announced with the public release.

Limitation of Liability

IN NO EVENT SHALL AITHERIUM, ITS FOUNDER, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your data or transmissions
  • Any bugs, viruses, or other harmful code that may be transmitted through the Service

Changes to These Terms

Aitherium reserves the right to modify these Terms of Service at any time. Changes will be posted to this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the new terms.
