AitherOS is in active alpha development. There is no reasonable expectation of data privacy, security, redundancy, or availability. By using this service you acknowledge these limitations and accept all associated risks.
This document is a standard template pending review by legal counsel and is not yet a substitute for advice from a licensed attorney. These terms may not be applicable to your specific jurisdiction or business needs. Aitherium recommends consulting with a qualified legal professional before relying on these terms as binding legal agreement.
By accessing, browsing, registering for, or using AitherOS, any Aitherium website, mobile application, or associated services (collectively, the "Service"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.
These Terms apply to all users and visitors, including those with registered accounts and those accessing demo instances or public features. Your use of the Service constitutes acceptance of these Terms.
Aitherium provides AI-native infrastructure and agent platform services (the "Platform"). The Service includes cloud-based and self-hosted deployment options, AI model inference, workspace management, integration tools, and related features. The specific features and functionality available depend on your subscription tier and any purchased add-ons.
Aitherium may add, modify, or discontinue features at any time. The Platform is provided on an ongoing basis; it is not a one-time purchase. Use of the Service requires a compatible device and internet connection (for cloud-based deployments).
You represent and warrant that you are at least 18 years old (or the age of majority in your jurisdiction) and that you have the legal authority to enter into these Terms. Accounts registered by or for individuals under 18 are not permitted.
You are responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify Aitherium of any unauthorized access or use of your account. You are liable for all activities that occur under your account. You may not share your account credentials with third parties or use another person's account without permission.
If you purchase a subscription or paid service, you agree to pay all fees and charges that you incur, in the currency specified. Billing occurs at the interval you select (monthly, annually, or as otherwise agreed), and your payment method will be charged automatically unless you cancel your subscription.
Subscription prices are subject to change with 30 days' written notice. Price changes take effect at the beginning of your next billing cycle. You are responsible for providing accurate billing information and promptly updating it if it changes.
You agree not to use the Service in any way that violates any applicable law, regulation, or these Terms. Prohibited uses include, but are not limited to:
Ownership of the Platform: Aitherium (and its licensors) own all right, title, and interest in the Service, including all software, designs, documentation, logos, and proprietary content. You are granted a limited, non-exclusive, non-transferable license to use the Service as permitted by these Terms.
Your Content: You retain all ownership rights to any data, files, or content you create, upload, or input into the Service ("Your Content"). By using the Service, you grant Aitherium a worldwide, royalty-free license to use, reproduce, process, and display Your Content solely to provide the Service and as otherwise permitted by your account settings and applicable privacy policies.
Feedback: Any suggestions, feedback, or ideas you provide to Aitherium may be used without restriction or compensation to Aitherium.
Aitherium treats Your Content as confidential. We commit to protecting Your Content in accordance with our <link>/privacy|Privacy Policy</link> and applicable data protection laws. Aitherium will not access, use, or disclose Your Content except as necessary to provide the Service, comply with law, or as you explicitly authorize.
You are responsible for maintaining appropriate backups of Your Content. Aitherium is not liable for loss of Your Content except to the extent required by applicable law.
DISCLAIMER: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
Aitherium does not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AITHERIUM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF AITHERIUM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In jurisdictions that do not permit such limitation, Aitherium's total liability shall not exceed the fees you paid in the 12 months preceding the claim.
You agree to defend, indemnify, and hold harmless Aitherium from any third-party claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.
You may terminate your account and use of the Service at any time by following the account deletion process in your settings or by contacting support. Upon termination, your access will end immediately.
Aitherium may suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, if it determines that you have violated these Terms or engaged in prohibited conduct.
Upon termination, your right to use the Service ceases. You remain liable for any fees or charges incurred through the termination date. Sections regarding limitation of liability, indemnification, and governing law survive termination.
Aitherium may update these Terms at any time by posting the updated version to this page with a new effective date. Continued use of the Service after changes become effective constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.
These Terms and your use of the Service are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction and venue of such courts.
